This End User License Agreement ("Agreement") is a legal agreement between you ("End User" or "you") and Aionics OÜ ("Company," "we," "us," or "our") for the MAI Pain App mobile application software, including all related documentation and updates ("Software" or "App").
BY CLICKING "ACCEPT," DOWNLOADING, INSTALLING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THE TERMS OF THIS AGREEMENT. IF YOU DO NOT AGREE, DO NOT DOWNLOAD, INSTALL, OR USE THE SOFTWARE.

The Software is licensed, not sold. Aionics OÜ retains all right, title, and interest in and to the Software, including all intellectual property rights. This Agreement does not grant you any rights to trademarks, service marks, or trade names.
Any feedback, suggestions, or ideas you provide about the Software become the property of Aionics OÜ and may be used without compensation to you.
The Software may include third-party components subject to separate license terms, which will be made available to you.
The Software may automatically download and install updates. These updates may include bug fixes, feature enhancements, or new versions. By using the Software, you consent to automatic updates.
We are not obligated to provide updates, maintenance, or support for the Software unless separately agreed in writing.
Your use of the Software is subject to our Privacy Policy, which is incorporated into this Agreement by reference.
You acknowledge that:
We may collect anonymous usage analytics to improve the Software, subject to our Privacy Policy.
THE SOFTWARE IS NOT A MEDICAL DEVICE AND IS NOT INTENDED TO DIAGNOSE, TREAT, CURE, OR PREVENT ANY DISEASE OR MEDICAL CONDITION. ALWAYS CONSULT QUALIFIED HEALTHCARE PROFESSIONALS FOR MEDICAL ADVICE.

THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL AIONICS OÜ BE LIABLE FOR:
THESE LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
You agree to indemnify, defend, and hold harmless Aionics OÜ and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses arising from:
You may terminate this Agreement at any time by deleting the Software from all your devices.
We may terminate this Agreement immediately if:
Upon termination:
You may not export or re-export the Software except as authorized by Estonian law, European Union regulations, and the laws of the jurisdiction in which the Software was obtained.
If you are a U.S. Government end user, the Software is a "Commercial Item" as defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation."
This Agreement is governed by the laws of Estonia, without regard to conflict of law principles.
Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Estonia.
This Agreement constitutes the entire agreement between you and Aionics OÜ regarding the Software.
If any provision of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
No waiver of any term of this Agreement shall be deemed a further or continuing waiver of such term or any other term.
You may not assign or transfer this Agreement. We may assign this Agreement without your consent.
We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control.
Notices to you may be provided through the Software, App Store notifications, or the email address associated with your account.
Integration with Apple Health is subject to Apple's terms and conditions.
Your use is also subject to Apple's App Store Terms of Service.
The Software is not intended for children under 13. By using the Software, you represent that you are at least 13 years old.
We reserve the right to modify this Agreement. Continued use after modifications constitutes acceptance of the changes.
