Terms of Service for MAI Pain App

1. Agreement to Terms

By downloading, installing, or using MAI Pain App ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access the App.

2. Definitions

• "Service": The MAI Pain App mobile application and all related services
• "Company": Aionics OÜ, the developer and operator of the App
• "User": Any individual who downloads, installs, or uses the App
• "Health Data": Any information related to health status, medical conditions, or wellness metrics

3. Use License

3.1 Grant of License

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the App for your personal, non-commercial purposes strictly in accordance with these Terms.

3.2 License Restrictions

You shall not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, disassemble, or decompile the App
• Remove any proprietary notices or labels
• Use the App for any commercial purpose
• Violate any applicable laws or regulations

4. Medical Disclaimer and Limitations

4.1 Not Medical Advice

IMPORTANT: MAI Pain App is NOT:

• A medical device
• A substitute for professional medical advice
• Intended to diagnose, treat, cure, or prevent any disease
• A replacement for consultation with healthcare providers

4.2 Healthcare Provider Consultation

You should always:

• Consult qualified healthcare professionals for medical advice
• Seek immediate medical attention for emergencies
• Verify any health insights with medical professionals
• Not make medical decisions based solely on app data

4.3 Medication Management

While the App provides medication reminders:

• You are solely responsible for taking medications correctly
• Always follow your healthcare provider's instructions
• The App is not responsible for missed doses or medication errors
• Verify all medication information with your pharmacist or doctor

5. User Responsibilities

5.1 Accuracy of Information

You are responsible for:

• Entering accurate health information
• Keeping your data current
• Verifying medication details
• Ensuring data accuracy before sharing with healthcare providers

5.2 Account Security

You agree to:

• Maintain the security of your device
• Use available security features (Face ID/Touch ID)
• Not share your device access with unauthorized persons
• Immediately report any security breaches

6. Intellectual Property Rights

6.1 Ownership

The App and its original content, features, and functionality are owned by Aionics OÜ and are protected by international copyright, trademark, and other intellectual property laws.

6.2 User Content

You retain all rights to your health data. By using the App, you grant us a limited license to process your data solely for providing the Service.

7. Privacy and Data Protection

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of information as detailed in the Privacy Policy.

8. Third-Party Services

8.1 Apple Health Integration

• Integration with Apple Health is optional
• Subject to Apple's Terms and Conditions
• We are not responsible for Apple Health's data handling

8.2 AI Services

• AI analysis is performed locally on your device
• No health data is sent to external AI providers without consent
• AI insights are not medical diagnoses

9. Disclaimers and Warranties

9.1 "AS IS" Basis

The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or reliability of information

9.2 No Guarantee

We do not guarantee that:

• The App will be error-free or uninterrupted
• Defects will be corrected
• The App is free of viruses or harmful components
• Results from using the App will be accurate or reliable

10. Limitation of Liability

10.1 Maximum Liability

To the maximum extent permitted by law, in no event shall Aionics OÜ be liable for any:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or use
• Medical complications or health issues
• Medication errors or missed doses

10.2 Total Liability

Our total liability shall not exceed the amount paid by you for the App in the twelve (12) months prior to the event giving rise to liability.

11. Indemnification

You agree to indemnify, defend, and hold harmless Aionics OÜ from any claims, losses, liabilities, damages, costs, or expenses arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any inaccurate information you provide

12. Termination

12.1 Termination by You

You may terminate these Terms at any time by deleting the App from your device.

12.2 Termination by Us

We may terminate or suspend your access immediately, without prior notice, for:

• Breach of these Terms
• Illegal or harmful use of the App
• Request by law enforcement
• Extended period of inactivity

12.3 Effect of Termination

Upon termination:

• Your right to use the App ceases immediately
• All data stored locally remains on your device
• Provisions that should survive termination will remain in effect

13. Governing Law and Jurisdiction

13.1 Governing Law

These Terms shall be governed by the laws of Estonia, without regard to conflict of law provisions.

13.2 Jurisdiction

Any disputes shall be resolved in the courts of Estonia, and you consent to personal jurisdiction in such courts.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by:

• Posting new Terms in the App
• App Store update notifications
• In-app notifications

Your continued use after changes constitutes acceptance of the new Terms.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

16. Entire Agreement

These Terms constitute the entire agreement between you and Aionics OÜ regarding the use of the App, superseding any prior agreements.
